Font License Agreement

Please carefully read the following End User License Agreement (”Agreement”). This Agreement becomes a binding contract between you and Identitype upon your purchase of the Font Software license or installation of the Font Software. If you do not agree to be bound by this Agreement, you are not authorized to access, download, install, and/or use the Font Software.

Definitions

Font Software: Refers to the software or instructions that generate typeface designs when used on an appropriate device or devices, including all bitmap representations of the typeface designs and ornaments generated by the Font Software.
Identitype: Refers to Identitype AB, its successors and assigns, and its parent corporation.
Sales Receipt: The electronic document confirming your purchase of the Font Software license.

Grant of License

Upon payment in full, Identitype grants you a non-exclusive, non-transferable, terminable License to use the Font Software subject to all terms and conditions of this Agreement.

Installation

The Font Software may be installed and used on the number of computing devices specified on your Sales Receipt. For example, if the Sales Receipt specifies ”1–5 computers,” you may install and use the Font Software on up to five (5) computing devices. For additional installations, contact Identitype for a license upgrade.

Servers

You may install the Font Software on a single file server for use on a local area network (LAN), provided that the number of computing devices accessing the Font Software does not exceed the number specified on your Sales Receipt.

Backup Copies

You may make copies of the Font Software for archival purposes only, retaining exclusive custody and control. Copies must include all original documentation, copyright, trademark, and proprietary notices. Unauthorized sharing, lending, renting, or sale of copies is prohibited and constitutes a material breach of this Agreement.

Commercial Printers and Service Bureaus

To reproduce a document, you may provide required Font Software to a commercial printer or service bureau, on the condition that they destroy all copies afterward. You agree to take reasonable steps to ensure compliance.

Embedding of Font Software

You may embed the Font Software into electronic documents (e.g., PDF or Flash applications) for distribution to the general public, provided the document is distributed in a secure format preventing extraction of the embedded Font Software.

Derivative Works

Derivative works created from the Font Software are subject to this Agreement and may not be sublicensed, sold, leased, rented, or given away without express written permission from Identitype.

Rights Reserved

Identitype retains exclusive rights to the Font Software, its designs, copyrights, and trade names. All rights not expressly granted in this Agreement are reserved to Identitype.

Limited Warranty

Identitype warrants that the Font Software will perform substantially as documented for ninety (90) days following delivery. Warranty claims require returning the Font Software along with a Sales Receipt copy. Liability is limited to refunding the license fee or replacement of the Font Software, at Identitype’s discretion. Identitype disclaims all other warranties and shall not be liable for consequential damages.

Termination

Failure to comply with this Agreement terminates the License automatically, without notice. Upon termination, all copies of the Font Software must be destroyed.

Governing Law

This Agreement is governed by Swedish law, and disputes are subject to the jurisdiction of Stockholm courts.

Headings

Headings are for reference only and do not affect the meaning of this Agreement.

Privacy Notice

This Data Protection Notice has been prepared by Identitype. It describes the processing of Personal Data within Identitype and data subjects’ rights. By using the website, you confirm understanding and agreement with this Notice. Identitype reserves the right to modify the Notice, with changes posted on the website. Review the Notice periodically for updates.
